Acceptance of these terms
These Terms of Service ("Terms") form a legal agreement between you and SmileHealth ("SmileHealth", "we", "us" or "our"). They apply to your use of our website, our products and any related services (together, the "Services").
By accessing our website or placing an order, you confirm that you have read, understood and agree to these Terms, together with our Refund Policy and Privacy Policy, which form part of them. If you do not agree, please do not use our Services.

Eligibility
To place an order, you must be at least 18 years old, or the age of legal majority where you live if that is higher, and able to enter into a binding contract. Our products are not intended for use by children. Anyone under 18 should use them only with the guidance of a parent, guardian or dental professional.

The nature of our products
SmileHealth products are cosmetic teeth-whitening and oral-care products. They work by gradually lifting and temporarily removing surface stains and discolouration from the teeth. They do not permanently change the natural colour of your teeth.
Our products are not medicines or medical devices, and they are not intended to diagnose, treat, cure or prevent any disease or dental condition. Information on our website, packaging and social channels is for general information only and is not a substitute for advice from a qualified dentist or healthcare professional.

Results and ongoing use
The foods and drinks we consume every day, such as coffee, tea, red wine, cola, berries and sauces, along with tobacco use, continually stain the surface of the teeth. Whitening is therefore an ongoing routine, not a one-time treatment. Consistent, long-term use as directed is needed to reach and maintain results.
Results depend on conditions unique to each person, including natural tooth shade, enamel, the type and depth of staining, diet and lifestyle, and existing dental work such as crowns, veneers or fillings, which do not respond to whitening. Any before-and-after images, reviews or testimonials show individual experiences and are not a promise of the results you will achieve. We do not guarantee any specific shade, outcome or timeframe.

Safe and responsible use
You agree to read the product information and ingredients, and to follow all directions and warnings supplied with each product. You are responsible for checking that a product is suitable for you, including any allergies or sensitivities to its ingredients.
Some people may experience temporary tooth or gum sensitivity. If this happens, pause use. If it continues, stop using the product and consult a dental professional. We recommend speaking with your dentist before starting any whitening routine, particularly if you have dental work, sensitive teeth, gum conditions, or are pregnant or breastfeeding.

Orders, pricing and payment
Placing an order is an offer to buy. A contract is formed only when we confirm and dispatch your order. We may refuse or cancel any order, including where a product is unavailable, a pricing or description error has occurred, or we suspect fraudulent or unauthorised activity. If we cancel an order you have paid for, we will refund you in full.
Prices are shown in the currency displayed at checkout and may change at any time without notice. A change does not affect orders already confirmed. If your bank or card provider converts the amount into another currency, any exchange-rate differences or fees they charge are outside our control. Payment is processed securely by our third-party payment providers, and you confirm you are authorised to use the payment method you provide.

Shipping and international orders
We ship to customers around the world. Delivery times are estimates and vary by destination, carrier and customs processing. You can follow your parcel on our order tracking page.
Risk in the products passes to you on delivery. You are responsible for giving a complete and accurate shipping address. For international orders, you act as the importer: any customs duties, import taxes or fees charged by your country are your responsibility. It is also your responsibility to make sure our products may be lawfully imported and used where you live.

Refunds, returns and exchanges
Because our products are personal health and hygiene products, all sales are final once an order has shipped. We do not offer refunds, returns or exchanges on shipped orders, except for replacements of damaged, faulty or incorrect items as described in our Refund Policy, which forms part of these Terms.

You agree to use our website lawfully. You must not:

You grant SmileHealth a worldwide, royalty-free, non-exclusive licence to use, reproduce and display it in connection with our brand and Services. We may moderate or remove content at our discretion.

All content on our website, including the SmileHealth name, logos, product names, text, images, graphics and design, belongs to SmileHealth or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify or use it for commercial purposes without our prior written consent.

Limitation of liability
To the fullest extent permitted by law, SmileHealth will not be liable for any indirect, incidental, special or consequential loss, or for results that differ from your expectations. This includes loss arising from misuse of a product, failure to follow its directions, or individual reactions or sensitivity.
Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify SmileHealth, its owners, team members and partners against any claims, losses or costs, including reasonable legal fees, arising from your breach of these Terms, your misuse of our products or website, or your violation of any law or third-party right.

These Terms are governed by the laws of the jurisdiction in which SmileHealth is registered, without affecting the mandatory protections you are entitled to where you live.

Changes and general terms
We may update these Terms from time to time. The version published on this page when you place an order applies to that order. Continuing to use our website after changes are posted means you accept the updated Terms.
If any part of these Terms is found to be invalid or unenforceable, the rest remains in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and SmileHealth regarding the Services.
